Terms & Conditions

These terms and conditions apply to all coaching services provided by The Elite 1% Performance Academy ("E1", "we", "us"), including the 10 Athlete Academy, 1:1 private coaching sessions, 1:1 personal coaching sessions, couple coaching and the 8 Week Transformation.

By submitting an application and ticking the acceptance box, you confirm you have read, understood and agree to these terms. If the applicant is under 18, a parent or legal guardian must read and accept these terms on their behalf.

Submitting an application does not guarantee a place. Places are limited and applicants are assessed on suitability, goals, availability and, where relevant, performance testing.

We may decline or withdraw an application at our discretion. Coaching begins only once a place is confirmed in writing and any required payment has been made.

Coaching involves physical exercise, which carries inherent risk of injury. You confirm that you are medically fit to take part and that you have disclosed any injury, illness, medication, pregnancy or condition that may affect your ability to train safely.

We are not medical professionals. Nothing provided by E1 is medical advice, diagnosis, treatment, or a substitute for advice from your doctor or physiotherapist. You should seek medical clearance before starting any new training or nutrition programme.

You must stop immediately and inform your coach if you feel pain, dizziness or discomfort. You train at your own risk and take responsibility for exercising within your own limits.

You agree to provide accurate and complete information, to keep us updated on any change to your health or circumstances, to follow coaching instructions and technique guidance, and to behave respectfully towards coaches, other athletes and any venue used.

We may end coaching without refund where behaviour is abusive, unsafe, or repeatedly disruptive.

Fees, inclusions and payment schedule are confirmed in writing before coaching starts. Payment is due in advance of the session, block or programme unless otherwise agreed.

Where a programme is paid in instalments, all instalments remain payable for the full agreed term even if you stop attending. Late or failed payments may result in sessions being paused until the account is settled.

Prices may change for future blocks or programmes; any change will be communicated before you renew.

Please give at least 24 hours' notice to cancel or reschedule a session. Sessions cancelled with less than 24 hours' notice, or missed without notice, are charged in full and are not rescheduled.

If we need to cancel a session, we will offer a reschedule or credit the session.

Programme fees (including academy places and the 8 Week Transformation) are non-refundable once the programme has started. In cases of long-term injury or illness supported by medical evidence, we may at our discretion pause your programme rather than refund it.

Every athlete responds differently. While we deliver our coaching with genuine care and expertise, we do not guarantee any specific performance, selection, physique or competitive outcome. Results depend on your consistency, recovery, nutrition, genetics and factors outside our control.

All training programmes, the E1 Method, the E1 Manual, videos, written material and other resources remain our intellectual property and are licensed to you for your personal use only.

You may not copy, resell, share, publish or coach others using our materials without our written permission.

Information you provide in your application and during coaching is used to assess suitability, deliver coaching and contact you. We keep it confidential and do not sell it.

We will only use photos, videos or testimonials featuring you in marketing with your permission, which you may withdraw at any time.

To the fullest extent permitted by law, E1, its coaches and representatives are not liable for injury, illness, loss or damage arising from participation in coaching, from failure to disclose relevant health information, or from failure to follow instructions.

Nothing in these terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993 or other law that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the amount you paid for the services concerned.

We may update these terms from time to time; the version published on this page at the time of your application applies to you.

These terms are governed by the laws of New Zealand.
